Privacy and Fair Processing Notice



1. Introduction



This is the Privacy and Fair Processing Notice of Calon Associates Limited. It sets out what personal data we collect, how we store and process it and your rights to access and delete the data we hold about you. It was last updated in May 2018.



2. Definitions



In this document, the following definitions apply:

 ‘We’, ‘Us’, ‘Calon’ means Calon Associates Limited 

‘You’, ‘Customer’ means a customer or prospective customer of Calon, or (where the customer is a corporate entity), an individual employed by or working on behalf of the Customer.

‘GDPR ‘means the General Data Protection Regulation (GDPR)

‘product’ means a product or service supplied by or on behalf of Calon.

‘data’ means the personal information which we collect, store and process as defined in section 3 below.



3. What data do we collect and process ?



We may collect, store and process the following information:

 

  • Your name, title, job title and preferred salutation;
  • Your contact information, including details of the organisation or company for which you work, your postal address, e-mail address and telephone number(s)
  • Other relevant information, for example the types of product you may be interested in; the areas of activity in which your organisation is engaged (which may include information regarding specific projects) and your role within the organisation.

 

We only collect, store and process information which is relevant to our current or future supply of products to you or your organisation and to the general development of our business. In particular, we do not collect or process information regarding your personal life, religious or political affiliations, ethnic background or any other personal information which is not relevant to the supply of our products or the development of our business.



4. When do we collect your data?



We collect data when you visit our website and request specific information (for example, when you download a product datasheet or other product information); when you register to receive news letters and information updates; when you contact us with a commercial or technical enquiry, or when you place an order for our products.

We may also collect and process aggregated data regarding use of our website, however this does not identify individual users in a way which allows their personal data to be identified or accessed.



5. What is the lawful basis for processing data?



Your data is collected and processed in accordance with one or more of the following lawful bases for processing provided for under the GDPR:

Contract – When you place an order with us, or make an enquiry prior to ordering (for example, to discuss an application or request a quotation). This is also the basis for any follow-up contact relating to that order (for example,if we contact you to advise you of a software update to a product you have previously purchased from us); 

Consent – Where you have explicitly opted to receive information from us.

Legitimate Interests - in pursuance of the legitimate interests of Calon in operating, developing and improving its business as a supplier of network infrastructure and open controls for lighting, buildings and retail applications.



6. How do we use your data?



We may use your data to process a technical or commercial enquiry; to fulfil an order; to keep you informed regarding updates or developments to products you have ordered or expressed an interest in, including but not limited to software updates and any safety or warranty-related issues.

We may also use your data to contact you regarding our Company, our products and general industry and technology trends. We may also use your data for the purposes of developing and improving our business processes and the products we offer to you.



7. Where do we store your data?



We store your data on our business systems which are hosted on secure servers located within the United Kingdom or European Union. Certain data is stored on secure servers located outside the European Union where we have verified that the hosting prividers appropriate data protection policies are in place.



8. How do we share your data?



Where you have asked us to supply a product, we may share your details with selected partners where this is necessary in order to provide you with this product. This may include our manufacturing, finance and logistics partners as well as third-party service providers (e.g. providers of maintenance services).   

We may share your data with our marketing and communications services providers to keep you informed of news regarding our Company, our products and industry and technology trends, in accordance with your contact preferences. 

In both these cases, we will take steps to ensure that these organisations have appropriate data protection policies in place. 

We may share your data with law enforcement agencies or official bodies if, and only to the extent, required by law.

If the ownership of Calon or its business is sold or transferred to a third party in the future, we may pass the data which we hold to the new owner as part of any sale or transfer of the business , to ensure business continuity.

Calon will not sell or lease your data to any third parties for marketing purposes. 



9. How long do we keep your data ?



Where we hold your personal data as a result of a commercial enquiry or transaction (for example, where you have ordered and we have supplied Product to you), we will retain your information for fifteen years. 

Where you have explicitly opted to receive information from us , we will retain your data for a period of five years. 

At the end of this retention period, we may contact you to ask you if you wish to receive further information from us.



10. Your Rights to access or delete your personal information



You may request details of personal information which we hold about you and ask for it to be corrected. With the exception of general exclusions, where processing is necessary, such as compliance with legal obligations or claims, you also have the right to request that all personal data be permanently removed from our databases without undue delay. 

Please be aware that should you ask to have your details removed entirely from our databases then we may not be able to provide you with support in the future.

Please include the details of your request, your name, email and postal address and any other information required to process your requirement. We reserve the right to request suitable evidence of your identity before releasing or deleting information.

We have a legal obligation to reply to your request within one month.  We will not make a charge for this service.



You have a right to lodge a complaint with the Information Commissioner’s Office (ICO) if you have a concern about how we are handling your personal information.



Calon has the right to change our Privacy Policy at any time and will communicate any such changes via this Privacy Notice. We would encourage you revisit this page on a regular basis.
